WAIVER, RELEASE AND INDEMNITY

FOR BICYCLE AND SCOOTERS
 
 
The Northam Toy Library ("Provider") is pleased to make bicycles and scooters available to subscribers ("the Service").

As a subscriber to the Service you acknowledge that there are dangers and risks inherent with bicycle and scooter riding

(the “Activity”) to which any child under your supervision ("Your Child") may be exposed.

The Provider does not provide protective clothing or bicycle helmets and it is your responsibility to ensure that Your Child

wears a helmet at all times and is otherwise appropriately attired when participating in the Activity. You agree that Your

Child will participate in the Activity at your own risk. You also agree to voluntarily assume responsibility for supervising the

Activity and any injury, death or property damage you or Your Child may suffer or cause as a result of participating in the

Activity.
 
To the maximum extent possible at law, you (both in your personal capacity and on behalf of Your Child) agree to release,



hold harmless and indemnify the Provider and its respective officers, employees, servants, agents and contractors (the

“Indemnified Persons”) against all actions, claims, suits, costs, expenses, demands and damages suffered or incurred by

the Indemnified Persons or any one or more of them by reason of, or in respect of, or in any manner whatsoever arising out

of, or caused by, your use of the Service or Your Child's participation in the Activity.

You agree that you are subscribing to the Service on the express condition that the Provider:

(a) will, under no circumstances be liable or responsible in any manner whatsoever for any death, loss, accident, damage or

injury to you, Your Child or any of your servants, agents, contractors, visitors or invitees or any other person whatsoever

(“Related Party”) which may happen as a result of your use of the Service or Your Child participating in the Activity; and

(b) will not incur or be under any liability whatsoever to you, Your Child, or to any Related Party for any loss, damage or

injury to or in respect of any of your property or of any Related Party’s property.

The Provider is not liable to you, Your Child or any Related Party in respect of any indirect or consequential loss. For the

avoidance of doubt, ‘consequential loss’ means loss or damage arising from a breach of contract, tort (including

negligence), under statute or any other basis in law or equity of an indirect or consequential nature including, but without

limitation, loss of profits, loss of revenue, loss or denial of opportunity, loss of goodwill, loss of business reputation, future
 
reputation or publicity, damage to credit rating and indirect, remote, abnormal or unforeseeable loss, or any similar loss



whether or not in the reasonable contemplation of the parties.

The Northam Toy Library is a non-profit organisation that was established in 2007 by a group of mothers to provide a muchneeded

service to the community within the Northam Shire.

FEES
- $60 per family per year for Active Members on Rostered Duty

- 1/2 price for grandparents of members

- $90 Corporate membership fee per year (Family Day Care providers, Community groups)
- NEW RATE $100 for Corporate or Family exempt from Rostered Duty

- You may pay ½ price if you join after September. (minimum joining fee $30)
- Support for fundraising is also expected to enable the purchase of new toys
HOW THE TOY LIBRARY OPERATES

COMMITTEE
All committee positions are voluntary from within the Toy Library membership. All share maintenance of membership files,

fines recorded and roster duties. One Member in charge of managing roster, sending roster reminders and any roster

changes.

President: Chairs monthly meetings, ensures smooth running of toy library and produces annual report.

Treasurer: Maintains books, pays accounts, deposits moneys, presents monthly report

Secretary: Maintains membership list, produces monthly minutes of meetings and any correspondence.
CATEGORIES & CODES OF TOYS
Toys are stored in general categories to assist in selecting items. Each toy has a code and tag with a description of all the

pieces of the toy and the appropriate age group.

PA - Physical Activity ST Small Toys ST - Small Toys

DU - Dress ups FG Family Games ED - Educational

HOW TO LOAN TOYS
You may borrow upto 5 items per family for upto 2 weeks. This can only include 1 extra large item (gold spot on tag) which

may be kept for upto 4 weeks. Once you have chosen your toy from the shelf, the Member on roster will scan the catalogue

number in the computer against your family membership number with the date borrowed and date due back. This is how we

keep track of the toys.
WHAT IS EXPECTED FROM YOU AS A MEMBER OF THE TOY LIBRARY

ROSTERS
You are expected to participate in roster duties. Rosters are emailed and on display on our notice board. Should you forget

to turn up on roster, or have not organised a replacement, the toy library will not open.
ANNUAL GENERAL MEETING
As a member, your attendance at the Annual General Meeting is appreciated. If you are a committee member, your

attendance is compulsory. Many important operating issues are discussed and voted on at the meeting. If you cannot

attend, please send your apologies, to the President, at least 1 week prior to the meeting date.
STOCKTAKE
Members are asked to contribute a couple of hours towards the stock take of all toys in the Toy Library. All toys must be

checked for safety, completeness, and thoroughly cleaned. Stock take normally occurs after the Toy Library has closed

during the Christmas/New Year break, but may happen at any time during the year.

All members are required to follow these procedures with regard to looking after toys and ensuring the smooth running of

the Toy Library.
HOW TO CARE FOR TOY LIBRARY TOYS IN YOUR HOME
One of the biggest concerns for most members of the toy library is losing pieces, or breaking a toy.

Here are a few helpful hints suggested by members:
§ Pack toys away each evening, counting all pieces as per tag description

§ Store packaging out of children’s reach to resist damage

§ Keep toys not being used in the Toy Bag/box

§ If you are expecting little visitors, pack toys away, or pieces can have a habit of going home in pockets

§ Ensure toys are stored INDOORS or UNDER COVER

§ Keep outside toys out of the rain and pack away every night

§ Keep toy library toys at home, do not take items to the shops or friend’s places

§ It is a good idea to clean and repackage toys the night before returning them, to avoid the last minute rush.

RETURNING TOYS TO THE TOY LIBRARY


Wipe all toys with a clean damp cloth removing all handprints, marks. Please disinfect all INFANT ACTIVITY toys. Ensure

all items are dry. PLEASE USE THE SPRAY & WIPE IN THE ENTRY AT TOY LIBRARY IF YOU FORGET.
BATTERY OPERATED TOYS
You are responsible for replacing depleted batteries. When returning battery-operated toys, the member on duty will check

that the toy is still operational.
DAMAGED OR LOST TOYS
If a toy is damaged/broken/missing parts, please do your best to find a talented friend who can make it re-usable. When

you return it to the toy library ask the member on duty to assess the toy and record any changes necessary on the tag and

in the communication book. If you cannot repair the toy safely, please return and report it to the Toy Library for assessment.
COMMUNICATION BOOK
This is to be used to let the committee know of any suggestions you have for the purchasing of new toys or

fundraising ideas. It is also used to record broken toys, missing pieces, etc. Committee will check it regularly.
ROSTER DUTIES
If you must bring your children with you when on roster, YOU are to supervise them at all times.
Committee Member Roster Duty Tasks
Arrive 10 minutes before opening time to open door, turn on computer, put out sign.

Check COMMUNICATION BOOK for tasks that need doing.

Scan toys in & out, checking thoroughly for completeness and cleanliness.

Receipt new memberships and monies.

If there is time, tidy toys and clean floor.

Bring in Sign, Lock doors, lock away key and SCRAMBLE the code.
Member Roster Duty Tasks
Arrive 10 mins before opening time, and help committee member set up.

Help Committee member to check in toys and ensure they are in good working condition with all pieces and cleaned.

Help members put toys back on shelves in correct category.

Learn how to operate computer system.

If there is time, member is to tidy toys and clean floor.

Please leave room neat and tidy and free from any food scraps or rubbish. Ensure all lights, heaters, air-conditioning etc

are turned off and doors and windows are locked.

Thank you for your help in running the toy library. Its existence relies on you and fellow members.
Remember: Young minds & bodies need new stimulating activities every day to grow – so let them play all day!
